Overpayments

Appealing an Overpayment

AUTHORITY

Assured Income for the Severely Handicapped Act, section 10(2)
Assured Income for the Severely Handicapped General Regulation, section 9(1)
Applications and Appeals (Ministerial) Regulation, section 5

INTENT

To describe what decisions the Appeal Panel can make when an overpayment has been assessed.

POLICY

A person assessed with an overpayment has the right to appeal the assessment.

The Appeal Panel has the authority to determine the following:

  • Whether the overpayment is valid;
  • The amount of overpayment; and
  • The rate of repayment.

The Appeal Panel may determine if an overpayment exists, and/or adjust the amount and/or adjust the repayment rate.
