Complaints | Investigations

After you file a complaint, the Office of the Public Guardian and Trustee will decide if an investigation is needed.

A complaints officer will contact you by phone to discuss your concerns. If it meets the criteria, it can be referred for investigation.

A complaints officer will let you know in writing that they have decided not to investigate. They may offer suggestions to address your concerns.

A complaints officer will let you know that your complaint has been referred for investigation.

They will make a reasonable effort to notify the other parties involved, including:

  • the person the complaint is against
  • the adult who you are concerned about
  • any other decision-makers (guardians, agents, trustees, etc.) for the adult

Your identity will remain confidential.

An independent investigator will be assigned.

Show Answer What happens during an investigation

Investigators will conduct interviews and review records to determine if the complaint is founded or not. This may take several months. They can make recommendations to resolve the situation.

If the adult is in immediate danger, the Office of the Public Guardian and Trustee can:

  • apply for a Temporary Protection Order so the adult can be immediately moved to a safe place
  • apply to have the person the complaint is against removed as agent, guardian, trustee or co-decision-maker so they no longer have decision-making authority

A letter about the outcome of the investigation will be mailed to:

  • the person who filed the complaint
  • the person the complaint is against
  • the adult who you are concerned about
  • any other decision-makers (guardians, agents, trustees, etc.) for the adult
  • service providers directly impacted by the result of the investigation
