Instructions

This form is used to provide notice to others that an application for review of a guardianship and/or trusteeship order or examination and approval of accounts on a trusteeship order has been made. This notice is sent to those people indicated in the application.

Please note that the portions of the form that you do not need can be left blank.

Top Section

Enter the Court file number and Judicial Centre that is on your existing order(s). Fill in the name of the person the orders are about. You are the applicant- please enter your name there.

1. Check all boxes that apply to your situation.

2. The Court sets the Hearing date. Fill in this information once you have received it from the Court.

3. If you are requesting the appointment of new guardian(s), trustee(s) or alternates or the existing guardian and trustees wish to have their appointments continued, please enter the appropriate information in section 3.

4. Please check the appropriate box(es) that match your situation. Follow Section 5.1 of the affidavit if you are amending (changing) the Order then identify the changes, e.g., adding an alternate guardian. If you are terminating the Order provide reasons why, e.g., the “adult” is no longer in need of a guardian (supported by the capacity assessment report). If you are discharging a guardian or alternate guardian provide reasons why, e.g., guardian no longer able to act due to ill health.

5. You may increase or decrease your authority from the current Order. If you wish to increase or decrease your authority you must explain your reasons why. Refer to the capacity assessment report where the capacity assessor will have identified the authority the guardian will need to assist the “adult”.

Note: The areas of Licences, Permits etc and Day to Day decisions do not exist under the Adult Guardianship and Trusteeship Act.

Note: “Any other personal matters….” Only check this box if you require authority in a specific area , e.g., specific diet that is not health related, such as a vegetarian diet or a religion base diet or refusal of a blood transfusion on religious grounds.

6. Please check the appropriate box(es) and if you are asking the Court to discharge a person as trustee or alternate trustee, you must fill in that person’s name.

7. Only check this box if the authority to sell land is included in the application documents.

8. Enter the start and end dates that cover the period of your accounting if your application includes an Examination and Approval of Trusteeship Accounts.

9. Check off those documents which would be available for those receiving notice to review if they want to do so.

The next section has  instructions and information for the person receiving the notice of application.

The final section  is for your address and contact information. If you are a lawyer completing this form, complete the first three lines with your information. If you do not have a lawyer completing this notice, do not complete the first three lines with law firm name, responsible lawyer’s name and lawyer’s file number. Complete the final lines with your street address, and other contact information as indicated.
