EI Verification Process

I01. Determining LMDA Eligibility - LMTA UPDATE

Purpose
Canada provides Alberta with access to personal information to assist Alberta to administer the Labour Market Development Agreement (LMDA).  The personal information is provided for the purposes of:
  • Verifying if an individual qualifies as an “insured participant ” and is therefore eligible for assistance under the LMDA, and 
  • Determining the nature and level of financial assistance to provide, if the individual is determined to be an active EI claimant.


Alberta has agreed that the information provided will not be used for a purpose other than that for which it has been provided.

Access to the personal information is provided through a secure web-based application, LMDAAccess.  The national application provides provincial/territorial and other jurisdictions the ability to query, in real time, an individual's eligibility. External service delivery partners are not permitted to have direct access to the federal application, but can submit a task via the Mobius work queue to determine eligibility when an individual is requesting training and employment assistance funded under the LMDA.

Procedure
Request for assistance received

  1. Check the Social Insurance Number to confirm that the individual is legally entitled to work in Canada.
    A Social Insurance Number is a nine-digit number that is needed to work in Canada.  Social Insurance Numbers beginning with ‘9’ are issued to temporary workers who are neither Canadian citizens nor permanent residents.  These temporary SINs are valid until the expiry date indicated on the Immigration document authorizing them to work in Canada. 
  2. If the Social Insurance Number begins with ‘9’ ask to see the immigration document (work permit) authorizing them to work in Canada to ensure that it has not expired.  Document the details of the permit(s) and expiry date as part of the assessment. If training is planned a study permit is also required. 
  3. If legally entitled to work in Canada, register or update the individual’s record in Mobius.  Proceed with the assessment and delivery of the employment service requested, if appropriate and enter the required administrative data in Mobius. For individuals requesting training assistance, that is eligible under the LMDA, proceed to 4.
    Individuals participating in the following individual-focused training activities are not claimed under the LMDA and therefore, do not need to be verified.

  4. Create a task for “CDS EI Verification” Work Queue.  Indicate that the subject is “LMDA Eligibility Request”. 
  5. The Work Queue manager will reserve the task, verify the individual’s LMDA eligibility and document the information on the LMDA Eligibility screen.  Once completed, the task will be returned to the Mobius user requesting the verification.

  6. Navigate to the LMDA Eligibility screen. Eligibility information is recorded in the Details section of the screen.   Review both the LMDA Eligibility and the LMDAAccess Reason to determine if the individual is eligible for training assistance under the LMDA.

    A recent application for an EI Part l claim has been made and is pending adjudication.
    Proceed to 7. b.
    Eligible   Premiums Paid  Premiums Paid Eligibility   An unemployed person who paid EI premiums in at least 5 of the last 10 calendar years that did not entitle the person to a refund.
    Note: If the person made less than $2,000 income in a year, any premiums that they would have paid would have been reimbursed when they filed their personal income taxes. 
     Proceed to 7. d.
    Premiums Paid Eligibility – New Claim Pending   An unemployed person who paid EI premiums in at least 5 of the last 10 calendar years that did not entitle the person to a refund.
    A recent application for an EI Part l claim has been made and is pending adjudication. 
    Proceed to 7. b. 


  7. If the LMDA Eligibility result is:
    1. Eligible – Active EI Claimant; OR
      Eligible – Active EI Claimant – Manual Pay System proceed to Determining Financial Assistance – EI  Claimant. (add hyperlink to named business process)
    2. Eligible - Former EI Claimant - New Claim Pending; OR
      Eligible – Premiums Paid Eligibility - New Claim Pending the results indicate that the individual is LMDA eligible. A recent application for EI benefits has been made and is pending adjudication. Weekly monitoring of the result of the EI application process is required (Proceed to 4.) until the claim is finalized.  
    3. Eligible - Active EI Claimant – Special benefits; OR
      Eligible - Active Claimant – Active Provincial/Territorial parental benefits claimant the results indicates that the individual is receiving EI special benefits.  To qualify for special benefits the individual has indicated, at the time they applied for benefits, that they are not working or taking training, and that they are unable to work at their job at this time.  The individual is likely still employed/labour market attached.  As such, they do not meet the suitability criteria  (Unemployed and Ready, Willing and Able) to be eligible to participate in training at this time. OR
      Eligible – Active EI Claimant - Provincial/territorial parental benefit established – Payment not initiated.  The results indicate that the individual has applied for provincial special benefits and been deemed eligible.  To qualify for special benefits the individual has indicated, that they are not working or taking training, and that they are unable to work at their job at this time.  The individual is likely still employed/labour market attached.  As such, they do not meet the suitability criteria  (Unemployed and Ready, Willing and Able) to be eligible to participate in training at this time.
    4. Eligible – Former Claimant OR
      Eligible - Premiums Paid Eligibility the process is complete.

  8. If the LMDA Eligibility result is:
    Ineligible – Does not meet eligibility requirements; determine if the individual has been employed, in an employer-employer relationship (paid EI premiums), in the previous 52-week period. If employed, refer the individual to Service Canada, as early as possible, to make an application for EI benefits.
    Ineligible – New Claim Pending; A recent application for EI benefits has been made and is pending adjudication. Weekly monitoring of the result of the EI benefit application is required, until the claim is finalized.  This result is required to determine the appropriate Client Funding Type and if a referral to training is required.
  9. For individuals who have met with an Authorized Official; been approved to leave their employment in accordance with the “Counsel to Leave Employment” policy; and the LMDA Eligibility result is Ineligible, the Authorized Official will edit the result to reflect Pending from the LMDA Eligibility drop down values.  The Authorized Official will also complete the Applying check box to signal that they have instructed the individual to apply for EI benefits, once unemployed.

Entering Client Funding Type Evidence in Mobius

Accurate identification of a “Client Funding Type” is necessary to meet reporting requirements/performance measures.  Individuals accepted and approved to attend full-time training programs are categorized as follows:
