Determination of Debt

AUTHORITY

Assured Income for the Severely Handicapped Act, section 9(1)

INTENT

To describe how and when an overpayment becomes a debt.

POLICY

A debt to the Crown, or a debt due, is money owed to the Government of Alberta. A debt may result from an overpayment of benefits.

An overpayment becomes a debt due when:

  • a client signs a repayment agreement to repay the value or amount of a benefit;
  • a Notice of Overpayment was sent to the individual, the appeal period has expired, and an appeal extension has not been granted;
  • 30 calendar days have passed since an affected party was asked in writing to reschedule an appeal hearing after failing to attend a previous appeal hearing; or
  • 30 calendar days have passed since an affected party was notified in writing of the appeal panel’s decision.
