Overpayments

Notice of Overpayment Assessment

AUTHORITY

Assured Income for the Severely Handicapped Act, sections 7(3) and 10

INTENT

To inform the person affected by an overpayment, how it was assessed and how the determination was made.

POLICY

When an overpayment is assessed, notification of the overpayment is communicated in writing to the affected party.

The following information is included in the notice:

  • Date of the overpayment;
  • Reason for the overpayment;
  • How the overpayment was calculated;
  • Amount of the overpayment;
  • Director's (or delegate's) decision to not waive the requirement to repay an assessed overpayment;
  • Right to appeal the overpayment amount, rate of repayment and the Director's (or delegate's) decision to not waive the requirement to repay an assessed overpayment; and
  • When it will become a debt due.


The affected party has 30 calendar days from being notified of the Director's (or delegate's) decision to not waive the requirement to repay an assessed overpayment, to appeal in writing. If the 30th day is not a business day, the date will be extended to the next business day. The date of the notification, plus seven calendar days, is considered to be the date the notification was received.

The 30-day time period can be extended if there are apparent grounds for appeal and a reasonable explanation for the delay.
