02 Income Support Overview

Delegated Authority to Make Eligibility Decisions

AUTHORITY
Income and Employment Supports Act, sections 6(2) and 15;
Income Support, Training and Health Benefits Regulation, sections1 (1)(p), 1(2)(a),  8 – 17, 19, 20 – 23, 100, Schedule 1 sections 1(1)(h) and 1(1)(o)  

INTENT

To outline the decision making authorities regarding eligibility decisions for Income Support.

POLICY

The authority/delegated authority to make decisions regarding eligibility for Income Support is as follows:

General Eligibility

Income and Employment Supports Act (IESA)

That at least one member of the household unit is at least 18 years of age.

Section 6(2)(b)

IS worker (Career and  Employment Consultant, Support and Financial Services Coordinator, or equivalent)

Whether an applicant or client is willing to comply with requirements under Part 5.

 

Section 6(2)(d)

IS worker

Whether the applicant or client is entitled to receive similar benefits from any other income support regime.

 

Section 6(2)(e)

(ISTHB Section 18)

IS worker

Income Support, Training and Health Benefits (ISTHB) Regulation

That the applicant’s immigration status meets residency requirements.

 

Section 10

Whether the members of the household unit are in Alberta.

Section 11

Financial Eligibility

Determine what savings programs could be an exempt asset for the purposes of determining eligibility for benefits.

Decide to Refuse, discontinue or suspend eligibility if it is determined that the client or applicant has:

IESA

Refused to seek or to accept reasonable employment for reasonable wages.

 

Section 15(1)(a)

IS worker

Terminated employment that they might have reasonably continued to hold.

 

Section 15(1)(b)

IS worker

Refused to make reasonable efforts to obtain compensation or to obtain compensation or to collect income that the client or another adult member of the household unit is entitled to or eligible for.

 

Section 15(1)(c)(i)

IS worker

Refused to make reasonable efforts to realize an asset or other financial resource that the client or another adult member of the household unit may receive or be entitled to receive.

 

Section 15(1)(c)(ii)

IS worker

Refused or neglected to avail themselves of advantages that they are entitled to under any other law.

 

Section 15(1)(d)

IS worker

Refused or neglected to take advantage of appropriate training or rehabilitative measures.

 

Section 15(1)(e)

Failed to maintain eligibility requirements for the Income Support benefits provided.

Failed to comply with any term or condition of the assistance provided.

Failed to comply with a direction under section 14(1)(a) or (c) to provide information required to audit IS eligibility, including substantiation of information if requested.

Failed to comply with a direction under section 14(2) to disclose a change in circumstances that would reduce the household’s eligibility for IS benefits.

 

Section 15(1)(h)

Failed to comply with requirements under Part 5 of IESA to comply with Child Support Services program requirements.

Refused to provide complete information required to determine eligibility for assistance or provide false information.
