Section 99 Reimbursement and assignment

For the purpose of section 16(2) of the Act, the Director may, as a condition of eligibility for assistance under Part 2 of the Act require a member of a household unit to enter into a repayment agreement or to provide an assignment in the following circumstances:
  1. a member of the household unit is entitled or potentially entitled to receive an award or settlement for a legal claim that is not exempt under Schedule 2;

  2. a member of the household unit is entitled or potentially entitled to receive a benefit from a government or a government agency that is not exempt under Schedule 2;

  3. a household unit receives assistance under section 100;

  4. the benefit is a supplementary income support payment described in the following:

    1. a utility access payment provided under section 23 of Schedule 4;

    2. a child supplement allowance provided under section 5 of Schedule 4;

    3. a relocation payment provided under section 13(c) of Schedule 4;

    4. an emergency payment provided under section 26 of Schedule 4, except

      1. for an amount provided for rental arrears to a household unit for the first time, or
      2. for an amount provided for an unpaid utility bill for the first time;

    5. a payment or allowance approved by the Minister under section 28 of Schedule 4;

    6. a refundable deposit;

  5. the benefit is a health benefit provided for replacement glasses, early eye exams or dentures.
