Income and Employment Supports Regulations

Income Support, Training and Health Benefits Regulation

Section 1 Interpretation

  1. In this Regulation,

     

    1. “Act” means the Income and Employment Supports Act;

       

    2. Repealed;

       

    3. “apprentice full time learner” means a person designated as an apprentice full time learner under section 5;

       

    4. Repealed;

       

    5. “approved training program” means a training program that is approved under section 20 of the Act;

       

    6. “cumulative full time training” means training provided to a learner member for an approved training program and training provided under contract with a training provider;

       

    7. “EI full time learner” means a person designated as an EI full time leaner under section 6;

       

    8. “excess of certain assets” means the excess of certain assets referred to in Schedule 3;

       

    9. “exempt asset” means an asset exempted under Schedule 1;

       

    10. “exempt financial resources” means a financial resource exempted under Schedule 2;

       

    11. “extended family” includes a child, grandchild, parent, step parent or grandparent but does not include a dependent child;

    14. Repealed:

       

    15. “learner member” means a person designated as a non EI full time learner, an apprentice full time learner or an EI full time learner;

       

    16. “liquid assets” means

       

      1. cash on hand or cash in a financial institution or held by a third party that must be paid to a member of the household unit on demand,

         

      2. stocks, bonds, term deposits and other assets easily converted into cash,

         

      3. a debt held by a third party that must be paid to a member of the household unit on demand, and

         

      4. a trust that must be paid to a member of the household unit on demand,

      but does not include an exempt asset or excess of certain assets;

       

    17. “non EI learner” means a person designated as a non EI full time learner under section 7;

       

    18. “non learner member” means a person who is not a learner member;

       

    19. Repealed;

       

    20. “shared family residence” means a residence where a household unit lives in the same self contained residence as an extended family member;

       

    21. “social housing” means housing in a housing unit that is operated and maintained by a management body under the Alberta Housing Act;

       

    22. “student funding” means a loan or grant, or both obtained under the Student Financial Assistance Act or the Canada Student Financial Assistance Act (Canada) or a similar loan or grant, or both as determined by the Director;

       

    23. Repealed;

       

    24. “training” means full time training unless otherwise specified;

       

    25. “training period” means the number of months within an approved training program for which a learner is funded, where there is no break for more than 3 consecutive weeks or a longer period that may be permitted by the Director;

       

    26. “training service plan” means a training service plan approved by the Director as provided for in this Regulation.

     

  2. For the purposes of the Act,

     

    1. “adult member” means a person who is

      1. 18 years of age or older and is not a dependent child,
      2. 16 or 17 years of age and is   

        1. the cohabiting partner of a person described in paragraph (B) or (C)  or subclause (i) or (iii),
        2. a learner member of a household unit, or
        3. determined to be an adult member in accordance with requirements specified by the Director,

          or 

      3. under 18 years of age and is an apprentice full-time learner;

        a.1  “approved home” means a home where residential support services are provided to adults with mental illnesses by agreement between the Minister of Health and the service provider;

        a.2   “cohabiting partner” means the person with whom a person

        1. is living and

          1. who is the person’s spouse,
          2. has a relationship of interdependence as defined in the Adult Interdependent Relationships Act, as determined by the Director, but does not include        

            1. a person related by blood or adoption unless there is an interdependent partner agreement as provided for under that Act, or
            2. persons under 18 years of age, unless one of the persons is at least 16 years of age and the other is at least 18 years of age,

            or

          3. has a natural or adopted child,   

            or

        2. has a relationship described in subclause (i)(A) to (C) and is financially interdependent;

    2. “dependent child” means a person

      1. for whom no financial assistance is provided under a Government of Alberta program designated by the Director,
      2. who is living with and dependent for support on an adult member,
      3. who is under 18 years of age or, if attending an education program under the School Act, under 20 years of age, and
      4. who is not an adult member under section (a)(ii) or (iii).

  3. For the purposes of section 5(2) of the Act,

    1. “budgetary requirements” for a household unit are determined under sections 24 and 51 of this Regulation;
    2. “financial resources available to a household unit”

      1. for a barriers to full employment household unit and expected to work or working household unit, are the financial resources determined under section 23 of this Regulation;
      2. for a learner household unit are the financial resources determined under section 50 of this Regulation plus any excess of certain assets of the unit available during the training period;

    3. “group home” means a home where residential support services are provided to adults with physical or mental disabilities or illnesses pursuant to an agreement between the Government of Alberta and the service provider;

    4. “hospital” means a hospital under the Hospitals Act;

    5. “learner household unit” means one of the following: 

      1. a non EI full-time learner household unit;
      2. an apprentice full-time learner household unit;
      3. an EI full-time learner household unit;

    6. “nursing home” means a nursing home under the Nursing Homes Act;

    7. “supplementary income support” means a supplementary income support payment or allowance described in Schedule 4.

  4. In section 17 of the Act, “unable to manage his or her own financial affairs” means the recipient’s inability, whether or not related to mental capacity, to manage his or her finances to consistently provide for food, shelter and health care.

  5. A reference to a barriers to full employment household unit in this Regulation is a reference to a not expected to work household unit referred to in section 6(1)(a)(ii) of the Act.

  6. A reference to a non EI full time learner household unit in this Regulation is a reference to a full time learner household unit referred to in section 6(1)(a)(iii) of the Act.

CPI Adjustment date

1.1 For the purposes of the Act, the CPI Adjustment date is January 1.
