Workers' Compensation Board Coverage - Advanced Education

INTENT

Learners receiving funding to attend an approved Advanced Education (AE) Foundational Learning (FL) program are eligible for WCB coverage if they are injured while attending training.

POLICY

If a learner is injured while participating in an approved AE – FL program, coverage is assured through an agreement between Government of Alberta and the Workers’ Compensation Board (WCB) known as a deeming order:

  • Learners attending a public institution are covered by Section 7(1)(c) of the Workers’ Compensation General Regulations which deems them to be workers of the Government of Alberta.
  • Learners attending a private institution are cover through an agreement between Alberta Advanced Education (AE) and the Workers’ Compensation Board (WCB) known as a “deeming order”.
  • Deeming orders do not apply when learners are engaged in homework, study or e-learning outside the training providers facilities.

Reporting an Incident

If a learner sustains an injury while participating in an AE - FL program, or job shadowing, the Workers’ Compensation Act of Alberta requires that injury reports are submitted within 72 hours of the injury. Visit WCB website to Report an injury.

Reports of injury may be submitted online or by fax.

The following reports / forms must be submitted by the training provider and the learner who suffered the injury:

  1. Employer report of injury – WCB form C040 (applies to training providers and/or employers providing job shadowing); they need to include the WCB deeming order account number
  2. Worker report of injury or occupational disease – WCB form C060 (applies to learner who is participating/attending a training program approved and funded by AE – FL and has suffered and injury while attending)
  3. Automobile accident report form – WCB form L054 if the injury was caused by a motor vehicle accident (applies to learner who is participating/attending a training program approved and funded by AE -FL and has suffered an injury during that period)
